The construction program regulates point source discharges of stormwater runoff from certain construction sites and was developed by the US EPA (United States Environmental Protection Agency) in two phases: Phase I regulates "large" construction activity (disturbing 5 or more acres of total land area) and Phase II regulates "small" construction activity (disturbing between 1 and 5 acres of total land area). Construction sites that disturb less than one acre of land but are part of a larger common plan of development or sale that can ultimately distrub one or more acres of land and can discharge to a regulated receiving water are usually regulated.

The "operator" (i.e., the entity that owns or operates the project and has authority to ensure compliance with the permit) of the regulated construction site must obtain an NPDES (National Pollutant Discharge Elimination System) stormwater permit and implement appropriate pollution prevention techniques to minimize erosion and sedimentation; control other sources of pollution and properly manage stormwater runoff.

The construction permit will usually require the following:

  • A permit application, often called a Notice of Intent (NOI) 
  • A Stormwater Pollution Prevention Plan (SWPPP or other term such as SWMP, CMBPP, etc.) which may include:
    • A narrative of how and where pollutants may be mobilized by stormwater,
    • A site plan for managing stormwater runoff,
    • Identification of appropriate erosion and sediment controls and stormwater best management practices (BMPs) to reduce erosion, sedimentation, and stormwater pollution,
    • A maintenance and inspection schedule and a
    • A recordkeeping process
  • Site inspections conducted by a properly qualified / certified (such as a CPESC) inspector that evaluates
    • Discharge locations,
    • Points of ingress and egress,
    • Disturbed areas,
    • Material storage location, and
    • Structural and non-structural controls
  • Notice of Termination to cancel your permit coverage
